Terms of Use for HometownNP Website and App

The following Terms of Service govern the use of the HometownNP website and mobile application (referred to collectively as “the Service”). Users are bound by these Terms when they access or use the Service. If you disagree with any part of these Terms, you may not access or use the Service.

Use of the Service

  1. Eligibility: You must be at least 18 years of age or be legally capable of entering into a contract to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
  2. License: Subject to these Terms, HometownNP grants you a limited, non-exclusive, non transferable, non-commercial license to access and use the Service.

User Content

  • User Responsibility: You are solely responsible for any content you post, upload, or transmit through the Service (“User Content”). It is your responsibility not to post or transmit any User Content that is unlawful, defamatory, obscene, offensive, or infringing upon any third-party rights.
  • Ownership: You retain ownership of your User Content. By posting or transmitting User Content, you grant HometownNP a worldwide, royalty-free, non-exclusive, transferable license to use, reproduce, distribute, prepare derivative works from, and perform your User Content as part of the Service.
  • Monitoring and Removal: HometownNP reserves the right to monitor, review, and delete User Content that violates these Terms, or which is otherwise objectionable, without prior notice.

Intellectual Property

    1. Service Content: The Service and its original content, features, and functionality are owned by HometownNP and protected by intellectual property laws. You may not modify, reproduce, distribute, or create derivative works of any part of the Service without prior written consent from HometownNP.
    2. Trademarks: HometownNP’s name, logo, and any other trademarks and service marks displayed on the Service belong to HometownNP. It is prohibited for you to use these trademarks without our prior written consent.

Prohibited Conduct

  1. Use the Service for any unlawful purpose or in violation of these Terms.
  2. Falsify your affiliation with any person or entity or impersonate any person or entity.
  3. Interfere with or disrupt the Service or servers or networks connected to the Service.
  4. Engage in any activity that could harm or negatively impact other users of the Service.
  5. Use any automated means or scripts to access or collect information from the Service.
  6. Unauthorized access to any portion of the Service or any other systems or networks connected to it.

Warranty disclaimer

  1. The Service is provided on an “as is” and “as available” basis. HometownNP makes no warranties or representations, whether implied or express, regarding the accuracy, reliability, or availability of the Service.
  2. HometownNP does not warrant that the Service is uninterrupted, error-free, or virus-free. You use the Service at your own risk.

Liability Limitations

  1. In the maximum extent permitted by law, HometownNP, its affiliates, officers, directors, employees, agents, and licensors are not responsible for any direct, indirect, special, consequential, or punitive damages originating from the use of the Service.
  2.  In no event shall HometownNP’s total liability to you for all claims arising from the Service exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold HometownNP, and any of its affiliates, officers, directors, employees, agents, or licensors, harmless from any claims, damages, liability, and expenses (including attorneys’ fees) that may result from or in connection with your use of the Service, your violation of these Terms, or your violation of another’s rights.

Termination

HometownNP may, in its sole discretion, discontinue the Service at any time without notice or liability. Your right to use the Service will immediately cease upon termination.

Jurisdiction and Laws that Govern

Governing law and construction of these Terms will be the laws of the State of Illinois. In the event of any legal action or proceeding arising out of these Terms, such action or proceeding shall be brought exclusively in the courts of Will county Illinois.

Changes to the Terms

HometownNP reserves the right to modify or replace these Terms at any time. Updated Terms will become effective immediately after posting on the Service. Continually using the Service after any such changes constitutes your acceptance of the revised Terms.
